By participating as a user, you acknowledge that features may be modified, financial terms adjusted, and transactional rules optimized as the application undergoes live testing across North America (United States and Canada).
Welcome to SewMe (the "Platform", "Application", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding contractual agreement between you ("User", "you", or "your") and SewMe, governing your access to and use of our mobile application, website, and intermediation services.
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING THE PLATFORM. BY CREATING AN ACCOUNT, SUBMITTING A REQUEST, OR ACCEPTING A PROJECT, YOU AGREE TO BE BOUND ENTIRELY BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS THE PLATFORM.
1. Scope of Services & The Marketplace Intermediary Disclaimer
The SewMe platform operates exclusively as a peer-to-peer digital venue. It functions to connect independent custom apparel makers, tailors, and designers ("Sewists") with individuals seeking custom apparel, alterations, or custom garments ("Customers").
Independent Contractor Status: SewMe does not design, manufacture, pattern-make, cut, stitch, alter, quality-check, package, or physically handle any apparel items. Sewists are fully independent service providers and are not employees, joint ventures, or agents of SewMe.
No Warranty on Workmanship: SewMe does not inspect the professional proficiency, equipment, workspace sanitation, or physical capability of Sewists. The selection of a Sewist, negotiation of terms, and ultimate satisfaction with a completed project are strictly transactional risks managed between the Customer and the Sewist.
2. Eligibility and Cross-Border Jurisdiction
The platform is restricted to individuals residing within the United States and Canada. To register for an account, initiate a project, or accept an order, you must be at least eighteen (18) years of age or the age of legal majority in your local state, province, or territory. By creating an account, you represent and warrant that you hold the legal authority to enter into a binding financial and operational contract.
3. Escrow Workflow, Milestone Progress, & Financial Terms
To preserve transactional security between independent parties, SewMe requires strict adherence to an integrated milestone-and-escrow financial system powered by our payment gateway providers (including, but not limited to, Stripe).
Upfront Escrow Collection: Upon acceptance of a project quotation by both the Customer and the Sewist, the Customer must pay one hundred percent (100%) of the project cost upfront through the secure payment infrastructure of the platform. These funds are immediately captured and held securely by SewMe in a non-interest-bearing escrow holding account. No Sewist is authorized to purchase materials or initiate labor until SewMe explicitly reflects that the funds have been secured in escrow.
Milestone-Based Progress and Material Approvals: Projects are segmented into sequential verification steps displayed via the app’s digital Milestone Progress Page. The Sewist is required to upload photographic or video proof at key intervals (e.g., fabric sourcing confirmation, design pattern sign-off, initial cuts, mid-assembly adjustments). When a Customer inputs an approval response to a milestone, that approval constitutes an absolute, final, and irreversible acceptance of that specific phase. The Customer explicitly waives all current or future rights to file a claim, dispute, or refund request regarding materials, choices, colors, or structural adjustments that were visible and formally approved during that milestone check-in.
Final Delivery and the 24-Hour Inspection Window: Upon physical delivery of the finished item to the Customer, an automated 24-hour verification window commences. The Customer has exactly twenty-four (24) hours from recorded delivery confirmation to evaluate the work. If the 24-hour period expires without a formal digital dispute file, the escrow funds are automatically, permanently unlocked and routed to the Sewist’s connected payout account. A Customer may execute a digital "dispute flag" within this 24-hour window ONLY for severe structural defects or objective non-compliance with the finalized design specifications. A user cannot flag or contest any element previously signed off on the Milestone Progress Page.
4. Beta Commissions and Fee Restructuring
Because the platform is operating in a Beta environment, SewMe reserves the unencumbered right to implement, waive, or restructure its transactional commission schedules. The current projected target marketplace fee is evaluated at 8% of the total project value to offset structural payment network overhead, hosting infrastructure, and administrative arbitration. Users will be explicitly presented with the active marketplace fee layout within the user interface prior to finalizing any project payment or quotation acceptance.
5. Sizing, Measurements, and Fit Responsibilities
Custom apparel fabrication is fundamentally reliant on precise dimension inputs. The structural allocation of responsibility regarding fit is governed exclusively by the following guidelines:
Absolute Customer Obligation: The Customer bears sole, non-transferable responsibility for the sourcing, accuracy, and input of all relevant biological dimensions, measurements, and physical requirements requested by the app interface or requested specifically by the Sewist.
Exclusion of Sizing Claims: A Customer is structurally barred from filing a quality dispute, requesting structural modifications, or initiating a refund claim on the grounds of poor fit, physical tightness, or improper draping, provided that the Sewist executed the construction of the garment in mathematical alignment with the numerical measurement data logged inside the app text fields at the time of project initialization.
6. Delays, Missed Deadlines, and Abandonment
Sewists must complete fabrication and initiate shipping or delivery on or before the definitive target date mutually agreed upon via the platform. Failure to achieve timely delivery triggers the following automated tiered penalty framework:
Tiered Delay Discounts: If a Sewist misses the established completion date, their net payout is systematically minimized in tiers corresponding to the length of the operational delay. The total deducted percentage is directly passed down to the Customer as an automated discount on the finished product. The precise schedule of active temporal discount tiers is published and updated continuously inside the SewMe App Help Guidelines.
Project Abandonment & Material Non-Delivery: If a project is structurally abandoned by a Sewist, or if the delivery delay surpasses the maximum allowable threshold outlined in the app operational rules without explicit Customer waiver, SewMe reserves the right to terminate the project ledger, return a full or partial refund to the Customer, and impose platform restrictions on the offending Sewist.
7. Binding Platform Dispute Arbitration
In the event that a Customer files an active dispute flag within the 24-hour post-delivery inspection window, or if a project stalls due to structural breakdown between parties, both the Customer and the Sewist explicitly surrender the right to external judicial or third-party mediation.
Exclusive Final Adjudication: SewMe serves as the exclusive, final, and contractually binding arbitrator for any and all platform conflicts. SewMe retains absolute unilateral discretion to evaluate the photographic logs, milestone confirmations, chat transcripts, and sizing data to issue a final decision. This includes the right to distribute full escrow refunds to the Customer, issue full payouts to the Sewist, or divide funds via a partial settlement. Both parties agree that SewMe’s operational decision is definitive and unappealable.
8. Prohibited Platform Circumvention (Disintermediation)
Users are strictly prohibited from utilizing the SewMe messaging ecosystem, discovery features, or booking flows to solicit, negotiate, or complete transactions outside of the platform’s checkout framework to bypass commission fees. Any attempt to redirect payments outside of our Stripe interface will result in the immediate, permanent termination of all associated user and Sewist accounts, forfeiture of active beta privileges, and potential civil liability for lost platform earnings.
9. Intellectual Property and Content Rights
By uploading photographs, material logs, fit adjustments, or final garment designs to the platform, the user grants SewMe a perpetual, royalty-free, worldwide, sublicensable, and non-exclusive license to display, replicate, modify, and distribute said media assets for promotional, marketing, operational, and application improvement purposes. Sewists maintain primary intellectual ownership of their proprietary design variations, patterns, and independent drafting techniques.
10. Limitation of Liability and Governing Law
IN NO EVENT SHALL SEWME, ITS FOUNDERS, OFFICERS, DIRECTORS, OR TECH PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF THE APP OR THE WEARING OF PRODUCTS CONSTRUCTED BY INDEPENDENT SEWISTS.
These Terms and your use of the platform shall be governed by and interpreted strictly in accordance with the laws of the jurisdiction of incorporation of SewMe’s legal corporate entity, without regard to conflict of law principles. Any remaining legal actions must be pursued exclusively in the authorized courts of said corporate jurisdiction.
